Foundation
A Swiss foundation for the care of persons in biostasis.
The Patient Care Foundation is a foundation under Articles 80 et seq. of the Swiss Civil Code, with its seat in Hünenberg, Canton of Zug. It was established on 25 March 2024 and entered in the commercial register of the Canton of Zug on 3 April 2024 under CHE-301.786.586.
It is supervised by the Swiss Federal Supervisory Board for Foundations in Bern. Its accounts are audited annually by an independent auditor and submitted, with the activity report, to the supervisory authority.
Responsibility for a patient in biostasis is divided between three separate legal entities.
Each is independently constituted. None can unilaterally determine the conduct of the others. The separation is deliberate. An operating company is constituted to grow and to adapt. Long-term custody requires the opposite properties: constraint, continuity, and resistance to change. These functions are therefore held by different entities under different legal forms.
Patient Care Foundation
A foundation in Switzerland. Acts in the interests of the patients. Legal guardian of the patients' bodies and of the capital held for their care.
European Biostasis Foundation
A non-profit foundation in Switzerland. Owns and maintains the long-term storage facility in which patients are held.
Tomorrow.bio
A company incorporated in Germany. Provides standby and medical cryopreservation teams, and performs the cryopreservation procedure.
The foundation acts exclusively selflessly. It pursues neither commercial nor self-help purposes.
Statutory purpose
The foundation serves exclusively the care of persons placed in cryonic biostasis or other forms of biostasis, until such time as they are again considered legally alive, functional and independent.
This applies to persons currently held in biostasis and to those placed in biostasis after the foundation's establishment.
Maintenance
Maintenance of the biostasis of persons already held in it. Where the continued existence of the foundation or of its activities is under existential threat, the focus is the preservation of the neural structures, primarily the brain, of those persons.
Placement
Placement of persons into cryonic biostasis or other forms of biostasis.
Revival and reintegration
Revival of patients from biostasis, restoration of their health, and support in their integration into the society of the time and in regaining their legal independence.
Research into revival
Research directed at the revival of persons from biostasis.
Research into the procedure
Research to render the induction and maintenance of biostasis more efficient and more effective.
The foundation pursues its purpose throughout Switzerland and abroad.
It may undertake any operational or supporting activity falling within its purpose or standing in factual connection with it. It may cooperate with, support, establish or operate suitable institutions and organisations.
It may permanently transfer patients in biostasis, and responsibility and supervision for them, to another foundation or organisation where its statutory purpose is thereby better fulfilled, together with such assets and funding as that purpose requires.
Bodies of the foundation
The foundation has four bodies. The conditions of eligibility for the Foundation Board are fixed in the statutes, not in policy.
Foundation Board
Not fewer than three members. Term of office four years, renewable. The Board directs the foundation in accordance with the intent of the founders as fixed in the founding deed and represents it externally. It exercises all powers not expressly assigned to another body.
Management Board
Not fewer than one member. Term of office four years, renewable. Conducts the day-to-day business of the foundation under the direction of the Foundation Board.
Auditor
Elected annually, renewable. Holds the statutory licence and independence. May not belong to another body of the foundation, be employed by it, be closely related to members of its bodies, or be a beneficiary.
Advisory boards
The Foundation Board may appoint one or more advisory boards for technical matters within the scope of the foundation's purpose.
Eligibility for the Foundation Board
Nine conditions are fixed in the statutes. All must be met, and must continue to be met.
The Foundation Board may remove a member before the expiry of their term for good cause, or where any condition is no longer met. The burden of proof lies with the member concerned.
Submission of information for a background check on the Board's terms.
The member intends to be placed in biostasis after their own death.
The member has held an active and fully valid contract with a recognised biostasis institution for not less than three years.
The member holds a body donation contract with the Patient Care Foundation.
The member derives no advantage or disadvantage, direct or indirect, from the maintenance, alteration or termination of the biostasis of any patient. Improvement of the procedure itself is excepted.
The member undertakes in writing to maintain their professional education and to remain informed of the state of the art.
The member undertakes in writing to represent all patients in biostasis equally.
The member has been active in the field of biostasis for not less than three years prior to appointment.
The member has no relative or otherwise connected person among the foundation's patients.

Works in municipal public administration in the Canton of Zug. Formerly in the security sector, monitoring sensitive installations. Former board member of the CryoSuisse association. Trustee of the European Biostasis Foundation.

The foundation's accounts are audited annually and submitted, with the activity report, to the Swiss Federal Supervisory Board for Foundations.
The foundation's assets are administered on the principles of careful and professional asset management, namely security, diversification of risk, appropriate return and liquidity. Both the returns and the capital itself may be applied to the purpose.
